By accessing or using the Service, you agree to be bound by these Terms and any policies referenced here, including the Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization.
Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you confirm that you meet this requirement.
Accounts and Security
You are responsible for all activity under your account and for maintaining the confidentiality of your credentials. You agree to provide accurate information and to promptly update it if it changes. Notify us immediately if you suspect unauthorized access.
Acceptable Use
You agree not to misuse the Service. This includes, but is not limited to: attempting to bypass security or access non-public areas; reverse engineering or interfering with the Service; submitting unlawful, infringing, or harmful content; or using the Service in a way that violates applicable laws or regulations.
Input and Output
You retain your rights to content you submit, including URLs and materials you provide. You grant us a worldwide, non-exclusive license to process your inputs to provide and improve the Service. The Service generates outputs using automated systems and third-party models; outputs may be inaccurate, incomplete, or biased. You are responsible for evaluating outputs before relying on them.
Intellectual Property
The Service, including its software, design, and content (excluding your inputs), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.
Subscriptions, Fees, and Billing
Paid plans are billed in advance and may renew automatically unless cancelled. You authorize us and our payment processors to charge your payment method for applicable fees and taxes. We may change pricing with reasonable notice. Refunds, if any, are provided at our discretion or as required by law.
Free Tier and Limits
The free tier is subject to usage limits and feature restrictions. We may modify or discontinue the free tier at any time, with or without notice.
Third-Party Services and Links
The Service may integrate or link to third-party services, including identity providers, payment processors, and model providers. We are not responsible for third-party services, and your use of them is subject to their terms and policies.
Disclaimers
The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted or error-free.
Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claims arising out of or related to the Service is limited to the amounts paid by you to us for the Service in the 12 months preceding the event giving rise to the claim, or USD $100 if you have not paid.
Indemnification
You agree to defend, indemnify, and hold us and our affiliates harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or if necessary to protect the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
Changes to the Service or Terms
We may modify the Service or these Terms from time to time. If we make material changes, we will provide reasonable notice. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which the Service provider is established, without regard to conflict of laws rules. Disputes should be resolved in the courts of that jurisdiction unless applicable law requires otherwise. Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us.
